Coastal Housing Partnership has created this privacy statement to show we are committed to your privacy, and to disclose how we gather and disseminate information for our website. We recognize and respect your need for privacy and security as you visit our site. We at the Coastal Housing Partnership (referred to in the privacy Statement as "we") recognize the importance of protecting the privacy of all information provided by you, whether as a subscriber of our website, registrant for our programs, potential client of our services, recipient of email updates, or user or viewer of our website.  It describes the types of information that we gather about you, how we may use that information, whether we disclose the information to anyone, including under what circumstances that might occur, and the rights and choices you have with respect to your personal information, including your rights to direct what we may or may not do with the information.  We created this policy with a fundamental respect for the privacy of visitors, members, and users of our website and to guide our relationships with you.

Collection of Your Personal Information

Under the law, the term “personal information” is quite broad and includes “information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.”  Also, the definition of the term “consumer” covers most every person.

When you use or view our website, you may be asked to provide your personal information, depending on what part of the website you visit and the level of engagement or inquiry that involves you.  We may collect your name, email address, mailing or physical address, telephone number, company name, and other information required by an employer, employee, landlord or renter of property that you are interested in that you give us.  While you have complete control over the amount and nature of the information you disclose, your ability to use all  of the elements of the website may be limited based upon the amount and type of personal information you provide.

As is true of most websites, we automatically gather information about your computer such as your IP address, browser type, referring/exit pages, and operating system.  We may use cookies to keep track of your preferences.  Cookies are also used to collect general usage and volume statistical information that does not include personal information.  We use this information to improve our website and marketing efforts and conduct research and analysis.

Even after you disclose your personal information voluntarily or electronically, you have the right to require that we delete some or all of your personal information.  Upon your request, we will follow your clear instructions that are communicated to us in writing, either via e-mail addressed to rentals@coastalhousing.org or regular mail addressed to Coastal Housing Partnership, P.O. Use and Sharing of Your Personal Information

The purpose of our website is to assist in the connection of employees in local businesses that are our member companies, who may be potential tenants in local housing with property managers/landlords/property owners.  The purpose of collecting your personal information in the first place is so that we can provide the service our website is designed to provide.

Once you have entered the information requested to compete an online form, all future communications will occur directly between employees and property managers/landlords/property owners.  That means that no communications will take place through our website, although we may attempt to contact you by email regarding your inquiry if there is a problem with the information entered.  We will not participate in any other communication with you without your advance knowledge and consent. 

We do not sell or otherwise disclose information outside of our organization. We will not send you any unsolicited email offers (i.e. spam or special offers). The only information that we collect is information that you have given us, including your name, name of your employer, e-mail address, and any property search criteria that you have entered and saved, including your log-in credentials (username, password).

You may manage your personal information by making various choices, including updating information that is not accurate or current, changing your log-in information, and deleting all or any portion of your personal information.

Newsletters

If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you.  Out of respect for your privacy, we provide a way to unsubscribe.

Security

We take reasonable precaution to protect your personal information and to store it securely.  In addition, access to all of your information is restricted to our authorized employees.  All of our employees are required to adhere to our strict privacy policies, and we enforce this requirement to the fullest extent.

It is important for you to protect against unauthorized access to your password and to your computers, devices, and applications.  We encourage you to be sure to sign off when finished using a shared computer.

As stated above, you can choose not to provide certain information, but then you might not be able to take advantage of some or all of the parts of this website.

Access to the Website by Children

We do not sell anything and the subject matter of our website is not designed for children.  We do not provide any services to users under the age of 13, and we do not knowingly collect any personal information from children under the age of 13.  Should we become aware that information entered into any part of our website contains the personal information of a child under the age of 13, we will delete it.

No Discrimination

We will not discriminate against any consumer for exercising rights under the California Privacy Act or otherwise.

Changes to this Privacy Policy

Coastal Housing Partnership will occasionally update this privacy policy related to this website. For material changes to this statement, we will notify our users by placing a prominent notice on the site.

Terms of Service

Introduction and Agreement

These Terms of Service apply to the services offered by the Coastal Housing Partnership, a California Nonprofit Corporation (referred to as “We” or “Us”), in connection with the rentals.coastalhousing.org  website or the Coastal Housing Partnership website https://www.coastalhousing.org, and related mobile applications (collectively the “Sites”). We, the operators of this Website, provide it as a public service to our users.  Any individual who visits, views, accesses, or uses any version of the Sites (referred to in these Terms of Service as “You” or “User”) is bound by these Terms of Service. By using the Site, You represent and warrant that You are at least eighteen (18) years of age, you have read these Terms of Service, and You agree to be bound by all of the following provisions of these Terms of Service, all of which form a legally binding contract between You and Us.  If You do not agree to these Terms of Service, You are prohibited from accessing the Sites and must immediately discontinue such access.

By accessing the Sites, You consent to the collection and use of certain information, as specified in the Privacy Notice below.

The Sites are Information Service Providers and a Rental Matchmaking Service

The Sites are designed to provide information and to enable potential renters of housing who are employed by our member companies, to connect with landlords/landladies/property owners.   We provide certain search capabilities that assist in locating suitable housing.  We do not: (a) participate in the actual pairing of renters and property owners; (b) broker, lease, or sublease or offer to broker, lease or sublease, or own apartments or other housing directly; (c) participate in or become a party to any transaction between landlords (including, as applicable, property management companies and/or property managers) and renters: (d) guarantee or ensure any apartment or any transaction between a renter and landlord; (e) conduct background screening on rental candidates, execute any lease or sublease documentation on behalf of renters or landlords or collect payment on behalf of renters or landlords; (f) act as a property manager, broker, payment processor, money transmitter, payment manager, debt collector, or credit reporting agency; or guarantee any results from using the Sites; (g) review landlord’s adherence to fair housing practices, policies, rules or regulations, or laws, or monitor or guarantee their compliance with those things.  ; (h) guarantee, warrant, or verify the truth or veracity of the statements or representations made by renters or potential renters; or (i) confirm or guarantee continued employment of renters or potential renters.  Before You enter into any transaction, We strongly encourage You to personally inspect any housing listed for rent and create a relationship with the other party to the transaction.  You should not sign any lease documentation or rental agreement, provide personal information such as a social security number on a lease or rental application, or wire or otherwise send money for any deposit, rent payment, or application fee through the Sites or without connecting directly with a property owner or manager. By using the Sites, You acknowledge that information contained on the Sites is subject to change at the sole discretion of the property owner or manager at any time and without further notice.  We reserve the right to restrict or refuse service and/or access to anyone at any time, in our sole and complete discretion.  

Site Materials

All information and content available on these Sites (collectively, the “Materials”) are protected by copyright and other intellectual property laws. The Materials are owned by Us and/or others from whom permission has been granted to allow Us to post on the Sites.  The Materials are intended for personal and noncommercial use only.  You may not copy, reproduce, sell, license, publish, distribute, modify, display, perform, combine, create a derivative work from, re-post, or otherwise use any portion of the Materials in any other way or for any other purpose without Our prior written consent.

Claims of Copyright Infringement

We respect the intellectual property rights of others.  If You believe that your work has been copied and/or infringed on Our Site, You may notify Us by sending Us the necessary information in accordance with the notice requirements set forth in the Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(2) (“DMCA”) either via e-mail addressed to rentals@coastalhousing.org or regular mail addressed to Coastal Housing Partnership, P.O. Linking Not Allowed

You are not permitted to link our site to any other site without Our express, written permission obtained in advance.  In the event permission is granted, such permission may be withdrawn at any time and for any reason or no reason at all.

User Content

You may not post any ads, photos, descriptions, data, or other information (“Content”) to the Site in connection with a listing without Our express, written permission obtained in advance.  In the event permission to post Content is granted, You grant Us a royalty-free, perpetual, irrevocable, nonexclusive, fully transferable, fully sub-licenseable right and license to copy, modify, display, distribute, perform, create derivative works from, store, and otherwise use and exploit all such Content in any form, media, software or technology of any kind now existing or developed in the future. You further grant Us a royalty-free right and license to use your name, image, and likeness in connection with the reproduction or distribution of the Content.  You may not use the Site to engage in any Prohibited Activities (as defined below). Uploading copyrighted or other proprietary material of any kind on the Site without the express permission of the owner of that material is prohibited and may result in civil and/or criminal liability.

Representations / Indemnity

You hereby represent, warrant, and agree that (a) You have all necessary authority, rights, and permissions to submit the Content to Us; (b) the Content does not and will not infringe or misappropriate any copyright, trademark, trade secret, patent, or any other intellectual property or other right of any third party, including any rights of privacy or publicity; (c) the Content and Your use of the Site does not and will not violate any applicable federal, state, or local law or regulation including, but not limited to, any fair housing laws or regulations or applicable real estate licensure or brokerage regulations, or cause injury to any person; (d) the Content is complete, truthful, accurate, and not misleading; (e) the Content has not been submitted in order to mislead, deceive, or defraud or seek to mislead, deceive, or defraud any other User of the Site; and (f) You will not mislead, deceive, defraud, seek to mislead, deceive, or defraud, make any misrepresentations to, or seek to make misrepresentations to, any other User of the Site. You acknowledge that these representations concern facts that are material to Us and the purpose of this Site. You agree to release, defend, indemnify, and hold Us, our affiliates, Licensors, sponsors, and their respective officers, directors, employees, agents, and contractors harmless from and against any and all claims, costs, demands or expenses, including attorneys’ fees, arising from (i) any distribution, publication, refusal to publish, removal, deletion, movement, editing, or other use of the Content You provide; (ii) your use of the Site or any reliance on the Materials; (iii) your breach of these Terms of Service; or (iv) any actual, prospective, or terminated lease or other transaction between You and a third party.

Prohibited Activities

You shall not:

  1. submit Content that is patently offensive to the online community, such as content that reflects or promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual;
  2. engage in activity or submit Content that could be harmful to minors;
  3. engage in activity or submit Content that harasses or advocates harassment of another person;
  4. engage in activity that involves the transmission of “junk mail” or unsolicited mass mailing or “spam” to others;
  5. engage in activity, submit Content, or promote information, that is fraudulent, false, misleading, inaccurate, and/or constitutes a misrepresentation, or promotes illegal activities or conduct that is abusive, threatening, obscene, vulgar, defamatory, libelous, or otherwise objectionable;
  6. submit Content that contains restricted or password-only access pages, or hidden pages or images;
  7. submit Content that displays pornographic or sexually explicit material of any kind;
  8. submit Content that provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
  9. engage in activities or submit Content that solicits passwords or personally identifiable information from others for unlawful purposes;
  10. engage in commercial activities and/or sales without Our prior written consent, such as contests, sweepstakes, barter, advertising, and pyramid schemes;
  11. use any robot, spider or other automatic device, or a manual process, to access, monitor or copy web pages or the Materials contained in the Site or for any other unauthorized purpose;
  12. use any device, software, or routine to interfere or attempt to interfere with the proper working of the Site; or
  13. take any action that imposes an unreasonable or disproportionately large load on the site or otherwise impedes or disrupts the functionality of the Site..

Compliance with Fair Housing and other Laws

All Content is subject to federal fair housing laws, which make it illegal to indicate in any advertisement any preference, limitation, or discrimination because of race, color, religion, sex, physical or mental disability, and/or familial status. Your state jurisdiction may also prohibit any preferences based on sexual orientation, marital status, ancestry, source of income, or other criteria (together, applicable federal and state fair housing laws are referred to as “Applicable Fair Housing Laws”). If You have any question about the fair housing laws and housing discrimination in general, please call your local fair housing agency or the U.S. Department of Housing and Urban Development. For a list of all fair housing groups, go to the Housing Rights Center’s website at hud.gov. Your provision, receipt, and/or use of any Content offered or obtained through the Site shall be at all times in compliance with Applicable Fair Housing Laws.  While we encourage all landlords to use best practices and to follow fair housing guidelines and regulations and laws, we assume no liability for violations of any fair housing laws rules, regulations, or policies.

Our Remedies

You acknowledge that any breach of these binding Terms of Service, including without limitation the sections “Site Material,” “Representations/Indemnity,” and “Prohibited Activities,” or any unauthorized use of the Site, is a material breach of this agreement between You and Us and will cause irreparable harm and injury to Us, for which there is no adequate remedy at law.  Material breach of these binding Terms of Service harms Our integrity, functionality, and reputation and detracts from trust in and use of the Site. Accordingly, You acknowledge and agree that We incur actual damages, which are extremely difficult or impossible to quantify, as a result of material breach of this these binding Terms of Service. For the avoidance of doubt, such damages would not constitute an adequate remedy at law or in any way affect your agreement that We would be entitled to injunctive or other equitable relief in the event of such breach.

Warranty Disclaimer

YOU EXPRESSLY AGREE THAT USE OF THE SITE AND RELIANCE ON ITS CONTENT IS AT YOUR OWN RISK. WE, OUR AFFILIATES, AND THEIR RESPECTIVE THIRD-PARTY LICENSORS DO NOT MAKE ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE SITE, THE CONTENT, CONSUMER PROVIDED INFORMATION, AND THE MATERIALS, OR THE RESULTS THAT MAY BE OBTAINED FROM USE OF ANY OF THEM. WE AND OUR AFFILIATES MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESSED OR IMPLIED, TO ANY ACTUAL OR PROSPECTIVE RENTER OF ANY APARTMENT OR HOUSING UNIT AS TO THE EXISTENCE, OWNERSHIP, OR CONDITION OF THE APARTMENT OR HOUSING UNIT; AS TO THE ADVERTISED AVAILBILITIES, RENT, LEASE TERMS, SECURITY DEPOSIT, OR APPLICATION FEES, IF ANY; OR AS TO THE ACCURACY OR COMPLETENESS OF ANY INFORMATION ABOUT AN APARTMENT OR HOUSING UNIT APPEARING ON THE SITE.  WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF SUCH INFORMATION. SHOULD IT COME TO OUR ATTENTION THAT THERE IS AN ERROR OR OMISSION ON THE SITE, WE RESERVE THE RIGHT, IN OUR SOLE DISCRETION, TO CORRECT ANY SUCH ERROR OR OMISSION ON THE SITE OR IN THE CONTENT AND/OR REMOVE ANY LISTING FROM THE SITE OR TERMINATE ACCESS TO THE SITE BY ANY USER. ANY AND ALL CONCERNS, DIFFERENCES, OR DISCREPANCIES REGARDING AN APARTMENT OR HOUSING UNIT MUST BE ADDRESSED WITH THE LANDLORD AND/OR PROPERTY MANAGEMENT COMPANY PRIOR TO LEASING OF THE APARTMENT OR HOUSING UNIT. WE DO NOT MAKE AND EXPRESSLY DISCLAIM ANY REPRESENTATIONS, WARRANTIES, OR GUARANTEES TO YOU.  Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to You.

Limitation of Liability

WE AND OUR AFFILIATES, AND THEIR RESPECTIVE OWNERS, EMPLOYEES, AGENTS, CONTRACTORS, AND THIRD-PARTY LICENSORS SHALL IN NO EVENT BE LIABLE FOR ANY DAMAGES OR LOSSES INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES, RESULTING FROM OR CAUSED BY THE SITE  OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, DAMAGES RESULTING FROM NEGLIGENCE. IN NO EVENT WILL THE AGGREGATE MAXIMUM LIABILITY OF OUR AND OUR AFFILIATES, AND THEIR RESPECTIVE OWNERS, EMPLOYEES, AGENTS, CONTRACTORS, AND THIRD-PARTY LICENSORS FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE EXCEED THE TOTAL AMOUNT OF FEES ACTUALLY PAID BY YOU FOR ACCESS TO THE SITE. Termination of Service

You understand and agree that in Our sole discretion, and without prior notice, your access to this Site may be terminated or suspended, and We may exercise any other remedy available and remove any Content, if we believe that your use of the Site and/or any Content or Information (a) violates (i) these Terms of Service, (ii) Our rights or those of Our affiliates, a Licensor, or another User, or (iii) any law or regulation, or are otherwise objectionable or inappropriate or (b) constitute fraudulent or unlawful activity of any nature. These Terms of Service may be changed at any time and You will be notified of any such changes by an updated posting of the new Terms of Service on this page of the Site. Your continued use of the Site after the posting of any amended Terms of Service shall constitute your agreement to be bound by any such changes. If for any reason a court of competent jurisdiction finds any provision of these Terms of Service, or a portion of them to be unenforceable, that provision of these Terms of Service will be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of these Terms of Service will continue in full force and effect. Failure by Us to enforce any provision of this Terms of Service will not be deemed a waiver of future enforcement of that or any other provision of these Terms of Service. These Terms of Service and any other terms and conditions or policies applying to Your use of the Site, constitute the entire agreement between the parties regarding the subject matter of these Terms of Service.
